No fines or repaying loans for asylum status holder under Wi2013

Asylum status holders under Wi2013 will not be fined any more. They also don't have to repay their loan.

Verdict about Wi2013 and asylum status holders

The highest administrative judge in the Netherlands, the 'Raad van State', issued a verdict in July 2025. Under theĀ 2013 civic integration act (Wi2013), DUO is not allowed to fine asylum status holders any more. DUO also isn't allowed to ask these asylum status holders to repay their loans.

Under theĀ 2021 civic integration act (Wi2021), DUO does not fine asylum status holders, but that may change in future.

What does this mean for asylum status holders?

  • Were you fined under the Wi2013 or Wi2021 on or after 1 February 2023? Then you don't have to pay the fine.
  • Did you receive a notice on or after 1 February 2023 stating you have to repay your loan under Wi2013? Then you don't have to repay your loan. Did you receive a notice about loan repayment before February 2023? Then nothing changes and you are still obliged to repay your loan.
  • If you are still integrating, you must continue to do so. Municipalities can still impose fines.

What do you have to do now?

You don't have to do anything. When your situation changes because of the verdict, DUO will send you a letter.

Are you a family immigrant or other migrant?

For you, nothing changes. DUO will still fine you under the Wi2013 and Wi2021 when you fail to integrate in time. And if you took out a loan, you will have to repay it.
